The Derbyshire County Council (B6417 Clowne to Pleasley and adjacent roads) (30mph, 40mph and 50mph Speed Limit) Order 2025 (Z3435). The proposals provide a 40mph speed limit on Mooracre Lane and Marlpit Lane. These 40mph speed limits have intermittent development in place and provide a stepped approach to vehicular speeds from the B6417 through to the more densely built up, residential environment of Bolsover. Speed data indicates existing speeds are consistent with a 40mph speed limit. The proposal provides a 40mph speed limit for the settlement of Oxcroft, which has intermittent development over a long length, with bends, a junction, and accesses. The proposal provides a 50mph speed limit replacing the derestricted speed limit from Clowne to Bolsover (except Oxcroft). Crown Court Proceedings: A20240037 Ian Wheeldon v Derbyshire County Council
We write to inform you that a member of the public has brought court proceedings against Derbyshire County Council under s56 Highways Act 1980 in relation to the grass verge that runs along the eastern side of Linacre Road, Chesterfield, Derbyshire. The member of the public argues that the verge is highway and that the Highway Authority is liable to maintain it. Derbyshire County Council are resisting the claims brought against them and are in active court proceedings.
This area of land is currently being developed by Tilia Homes Limited under Chesterfield Borough Council planning application reference: CHE/21/00707/FUL for 301 dwellings including the provision of public open space, landscaping and associated infrastructure and works. As per the court order, the judge has requested that we contact any party which may have plant or amenities in the aforesaid grass verge and who wish to be joined to the proceedings.
